This policy explains how the organisers of the Kitenge Fashion Festival handle personal data collected through kitengefest.com. It is written for the Kenya Data Protection Act, 2019, and the Data Protection (General) Regulations, 2021.
The site tells visitors about the Festival, including the 9th edition in Eldoret. It is also where a person can send a message, apply to take part, put a name forward for an award, or ask about sponsorship. Buying a ticket, and registering a designer on another website, are separate services. Those are described below.
Who is responsible
The organisers of the Kitenge Fashion Festival are the data controller for personal data collected through this website.
- Email: info@kitengefest.com
- Telephone: +254 723 879 704, +254 736 864 833, +254 726 538 136
- Correspondence: Rupa Mall Grounds, Eldoret, Kenya
This page does not quote a company registration number or an Office of the Data Protection Commissioner registration number. If you need those details, email us and we will tell you what is on record.
What this page covers
This policy covers kitengefest.com only.
Tickets are sold by Shika Ticko at shikaticko.co.ke. Payment details, the names on tickets, and refunds are handled by that service under its own terms and privacy notice. This website does not receive your card number.
Designer registration offered at groovehq.co.ke/apply/designer is handled on that site, under its own terms. This policy does not control that form.
The contact form
If you write to us through the contact form, we ask for your name, email address, a subject and, if you wish, a message. The form cannot be sent unless you tick the box agreeing to this policy and the Terms of Use. We use those details to read your enquiry and reply.
The legal basis is your consent. You can withdraw that consent by emailing us. Withdrawal does not undo a reply we have already sent. We do not add contact-form addresses to a mailing list, and we do not sell them.
Before a message is delivered, it is checked for spam by Akismet, a service of Automattic. Akismet may process the message, your IP address and basic browser details, and may do that outside Kenya, only to detect spam.
Applications to take part
This website has application forms for models, designers and sponsors.
A model application may include your name, country, location, telephone number, email address, gender, height, a portfolio, cover photographs, a link to a video, and the category you are applying in. Under the Act, data about a person’s sex is sensitive personal data. We collect gender only so the application can be placed in the right category.
A designer application may include your name, telephone number, email address, country, location, the category of your work, a portfolio, links to your social media pages, and a website address if you give one.
A sponsor enquiry may include an email address and a telephone number.
We use application data to decide whether to invite you, to contact you about that application, and to plan the edition you applied for. The legal basis is that you asked us to take these steps before any agreement about your participation, together with your consent in sending the form.
Sending a portfolio lets us review it. It does not, by itself, give us permission to publish your photographs or your work. If we want to use an image in publicity, we will ask you first, unless you have already agreed to that in writing.
We do not sell application files. People organising the Festival may see an application in order to assess it. A production, staging or security partner may see the details that partner actually needs if you are taking part.
Children
The model form includes a child-model category for ages 4 to 12. A child cannot agree to this on their own. An application in that category must be submitted by a parent or legal guardian. We use a child’s name, photographs and related details only to assess the application. We do not use them for marketing, and we do not sell them.
A parent or guardian can email info@kitengefest.com and ask us to delete that application.
Nominations
The nominations form asks for an award category and the name of the person you want to nominate. We use that name to administer the awards. Please nominate only where you are content for us to hold that name for this purpose.
The legal basis is the legitimate interest of running the awards, balanced against the person’s rights. Someone who has been nominated may ask what we hold and may object.
Cookies and technical data
The site uses essential cookies and similar storage so that WordPress and the page cache can serve the pages, keep a form secure, and remember a basic preference. We do not currently use advertising cookies or a marketing pop-up on this site. If that changes, we will update this policy before those tools are switched on.
The provider that hosts the website processes technical logs, such as an IP address and the page requested, so the site can stay online and be protected. We do not use those logs to build marketing profiles.
How long we keep information
- Contact messages are kept while we need them to correspond with you, and are then deleted.
- Application files are kept for the edition you applied to and for up to 24 months after that edition, unless we still need them for a shortlist or a dispute, or you ask us to delete them sooner and we are not required to keep them.
- Nomination records are kept for the awards cycle they belong to, and then for up to 24 months.
- Server logs are kept by the host for its usual security period.
Who we share data with
We do not sell personal data. We share it only in these cases:
- with the people organising the Festival, so they can answer you or assess an application;
- with Akismet, for spam checking of the contact form, as described above;
- with the hosting provider, so the site can run;
- with a partner who is producing, staging or securing the event, and only the details that partner needs;
- with a public authority, if Kenyan law requires the disclosure.
Your rights
You have the rights given by the Act. You may ask what personal data we hold about you, ask us to correct it, ask us to delete false or misleading data, and object to processing. Where we rely on consent, you may withdraw it.
Email info@kitengefest.com with the subject “Data request”. We may ask you to confirm that you are the person the data is about, or their parent or guardian. We will answer within the time required by the Act and the Data Protection (General) Regulations, 2021.
You may also complain to the Office of the Data Protection Commissioner at www.odpc.go.ke.
Changes
We will post any change on this page and change the date at the top. The Terms of Use explain how the site itself may be used.
